MAXWELL,ATTORNEY AT LAW,PAOLA, KANSAS.October 18, 1902.J.E.Everett Esq.,Topeka, Kansas."In re" Everett vs. Everett.Dear Sir: -- I have your favor of the 17th inst. and note contents. In reply say that it will be necessary to have the original Mortgages here with the Notes held by M.H.Everett. The rules of the Court require that the originals be filed when judgment is taken. I could prepare the pleadings on copies but the records do not show a copy of the notes; hence it will be necessary even to prepare the papers to have the original before me. As to the matter of fees there are two Mortgages and the labor in connection with this branch of the case will be just the same as if they were prosecuted as separate actions of foreclosure, and the minimum fee in such cases would be $25. for each case, but inasmuch as I represent you in the partition suit and you have to pay the fee on this branch of the case, I will attend to the collection of both Mortgages for one fee of $25. That would be $12.50 for each case. There will be a saving of about $15 in costs if this course is adopted. I could enter an appearance for the defendant M.H.Everett and save cost of publication of summons. The Attorney's fee of lien holders in partition suits is not fixed by the Court. The only Attorney's fee apportioned by the Court is for services rendered in the partition proceeding.  If you will procure the original papers, that is the notes and mortgages held by M.H.Everett I will see that her interests are protected and that her liens are paid out of the proceeds of the sale of the property.
